Despite such defenses however, two aspects work strongly in Mr. Mertonââ¬â¢s favor ââ¬â (a) the knowledge defendants had about his childhood trauma and the sign by which it was manifested externally and (b) the deceptive manner in which Mr. Mertonââ¬â¢s cooperation was elicited. Since Mr. Merton was subjected to a reappraisal of his childhood trauma purely to generate a newsworthy reality show, the outrageous criterion may be established. A lounge singer, the client, Mr. Murton, is currently unable to work, because he suffers from recurring panic attacks, clinical depression, and paralyzing stage fright. He claims that these serious conditions are the result of Barnett Productionsââ¬â¢ duping him into participating in a reality television show called ââ¬Å"Regular Guy.â⬠Specifically, he claims that, during the showââ¬â¢s taping, he was forced to partake in humiliating school-yard contests while a group of athletically gifted ââ¬Å"hunksâ⬠ridiculed his limited physical abilities. Mr. Merton states that during the taping of the recess segment, the hunks shouted insults. ââ¬Å"I remember, one of them said to another ââ¬ËWhat a bunch of losers. These guys look like 14-year-olds. We should kick their assesââ¬â¢ and another one said, ââ¬ËSee these babies squeal? I bet theyââ¬â¢re about to go in their pantsââ¬â¢.â⬠Mr. Merton states that he was subjected to a background investigation and psychological testing and passed both. According to Mr. Murton, the showââ¬â¢s producers also brought him to beach front property that was directly across from the school where Mr. Murtonââ¬â¢s bullying had previously occurred.
